The Illinois Department of Public Health (IDPH) is tasked with the oversight of communities within Illinois to achieve and maintain optimal health and safety. With an annual budget of over $600 million in state and federal funds, 7 regional offices, 3 laboratories and over 1,100 employees, IDPH is equipped to fulfill its mission of protecting the health and wellness of the people of Illinois through the prevention, health promotion, regulation and control of disease and injury.

Position Overview

The Illinois Department of Public Health is seeking a highly motivated individual to provide legal services and opinions to various programs administered by the Department.

Job Responsibilities

1. Provides legal advice, counsel and representation to the program and service units within the Department, including the interpretation of federal and state statutes and the rules and regulations promulgated thereunder, and the application of court decisions and general legal principles to programs administered by the Department.

  • Provides counsel for the protection of the Department’s legal interest and provides legal counsel and advice on regulatory matters for programs at the Department.

2. Prepares and examines draft/proposed/existing leases, contracts, and bid documents to determine compliance with Illinois law and Department policy, provides legal advice for the negotiation of specifications and contract provisions.

  • Prepare compliance reports.
  • Protects the Department’s legal interests.

3. Confers with the Attorney General’s staff or State’s Attorneys to collaborate upon the preparation of written evidence, the availability of witnesses, the preparation or defense of litigation in which the Department is a party.

  • Prepares statutory interpretations and makes determinations of compliance with various State and Federal Statutes

4. Provides legal assistance to Department program staff and conducts legal review and preparation of rulemaking including providing legal recommendations and proposed procedures.

5. Participates with other members of the legal staff, the Division of Governmental Affairs, and program personnel in the preparation of bills which have public health significance.

  • Makes determinations of impact and interprets legislation which has been proposed to the General Assembly.
  • Provides legal expertise in the preparation of rules, regulations and standards in the implementation of statutes administered by the Department of Public Health.

6. Responds to inquiries from the public and internally, concerning legal aspects of Department programs, policies and practices.

  • Explains the Department’s obligations and regulatory requirements.

7. Performs other duties as required or assigned which are reasonably within the scope of the duties enumerated above.

Minimum Qualifications

  • Requires knowledge, skill and mental development equivalent to completion of four years of college, preferably with courses in business or public administration.
  • Requires prior experience equivalent to three years of progressively responsible administrative legal transactional experience in reviewing legal transactional documents, drafting legal transactions, and providing legal guidance on grants and contracts pursuant to the Illinois Procurement Code and the Illinois Grant Funds Recover Act.
  • Requires the possession of a license to practice law in Illinois.

Preferred Qualifications

  • Thorough knowledge of common laws: Federal and State laws, regulations pertaining to the agency programs.
  • Extensive knowledge of judicial and quasi judicial and administrative procedures and the rules at all judicial levels.
  • Extensive knowledge of legal methods, practices and practices and procedures in the agency.
  • Working knowledge of principles of management, including organization, controls sand techniques used in dealing with management and procedural problems.
  • Two years experience planning, laying out, coordinating and reviewing the work of a technical or legal program or units.
  • Two years experience drafting complex and technical legal documents.
  • Ability to develop and maintain effective professional and public contacts and satisfactory working relationships with others.
  • Two years experience analyzing and appraising facts, evidence and precedents in developing pertinent issues.
  • Two years experience applying fundamental principles to unusual, difficult and complex problems.
